Getting a new technician started in Pennsylvania
In IBHS ABA, an RBT certification is the cleanest way to qualify as a BHT-ABA, but the regulation also allows a 40-hour RBT Task List training path with a BCBA/BCaBA trainer certification and a high school diploma, so a new technician can sometimes start before the BACB exam. The agency must hold an IBHS license, and Child Protective Services Law clearances apply. The pa.gov DHS bulletin pages were not retrievable, so check current OMHSAS bulletins and MCO policies. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- How a new MA ABA provider enrolls (PROMISe/DHS enrollment URL) and the current OMHSAS bulletin guidance; pa.gov DHS pages returned 404/redirects and were not read.
- Which commercial insurers and HealthChoices behavioral health MCOs are the major ABA payers (none sourced).
- Whether a Pennsylvania behavior specialist license is legally required to practice ABA outside IBHS behavior consultation, and the current license fee (49 Pa. Code 16.13).
- Whether telehealth is permitted for direct ABA services under MA/IBHS, and commercial telehealth parity as applied to ABA.
- The current CPI-adjusted annual maximum benefit under Act 62 and whether the Act 62 group-size threshold (51+) has been changed by later law.
- Exact clearance types (PSP criminal history, ChildLine abuse, FBI fingerprints) and timing for new technicians under the CPSL.
- Whether self-funded plans are subject to the Act 62 mandate (text read does not address it).
- How a new MA ABA provider enrolls (PROMISe/DHS enrollment URL) remains unverified. The earlier inability to retrieve DHS guidance was resolved for telehealth sources in this pass; enrollment guidance and MCO-specific policies were not audited.
- Statewide conditional IBHS telehealth permission and general commercial telemedicine coverage protections are now sourced. Specific ABA procedure-code eligibility, authorization and modifier requirements for each BH-MCO/commercial plan, commercial acceptance of non-RBT technicians, and any right of technicians to enroll or bill independently remain unverified.
- Whether remote observation can satisfy the separate onsite supervision and direct-observation requirements in 55 Pa. Code 5240.82(c)(2)-(3), including any currently applicable waiver, was not established; 5240.82(g) expressly authorizes video face-to-face supervision.
- autism_insurance_mandate: verifier astra marked conflict - The Act 62/Section 635.2/40 P.S. 764h citation and historical statutory summary are substantially supported. Update annual_cap: $36,000 is the original statutory amount; the published adjustment is $51,908 for policies issued or renewed in 2026, with $53,310 announced for 2027. Explain the conflict between the statute's cap language and subsequent parity requirements: PID Notices 2023-16, 2025-02 and 2026-06 require consideration of mental health parity and say the adjustment is not expected to affect coverage. Do not represent either adjusted figure as a universally enforceable payment ceiling. Set excludes_self_funded_plans to true for this state mandate; exclusion does not establish absence of coverage under other requirements. The under-21 limit, visit protection, CPI-U mechanism, July 2009 applicability, 51-employee threshold, listed government programs and insurance-entity references are supported. Adult basic is a statutory listing, not evidence of a currently operating program. Small-group exclusion concerns Act 62 specifically. Treatment must be medically necessary and satisfy the prescribing/provider conditions in subsection (f)(14). Add that mandatory contracting concerns providers within the insurer's service area accepting its applicable payment levels, terms and conditions. Six-month review is subject to utilization review, and another frequency may be agreed upon with the physician or psychologist.
- medicaid_aba: verifier astra marked conflict - Coverage, agency identity, under-21 population and adoption dates are supported. Add Chapter 1155: payment requires medical necessity, eligibility, a behavioral-health diagnosis, agency enrollment and applicable order/assessment/ITP conditions; technician qualifications alone do not authorize independent billing. The four service roles and six BHT-ABA alternatives are supported, including the historical July 1, 2020 deadline. Use exact license names: professional counselor and marriage and family therapist; the list also includes CRNPs and other appropriately scoped professionals. Behavior analytic services require a qualifying PA license plus BCBA or another qualifying graduate certification. Behavior consultation-ABA has distinct alternatives in subsection (e). Add high-school equivalency and, for the experience pathway, training supplied by a BACB-approved continuing-education provider as an alternative to Department approval. RBT is not universally required. Conflict: unchanged regulatory Task List wording must be accompanied by the April 2, 2026 OMHSAS guidance adopting current third-edition training terminology and transition expectations. For supervision, specify two ONE-HOUR sessions monthly below 37.5 hours, plus the monthly individual requirement. Six onsite hours apply when the person has not previously provided BHT-ABA services. The two-month observation interval specifically applies to subsection (g)(5). The 12-FTE/9-BHT-FTE limits are correct; group supervision separately has 12-person/9-BHT limits. HIPAA-compliant audiovisual face-to-face supervision is authorized; this provision does not establish client telehealth reimbursement. Section 5240.83's cross-references and 20-hour annual ABA training requirement are supported. Stricter particular agency/MCO requirements remain unverified.
- bt_vs_rbt: verifier astra marked conflict - The central conditional conclusion is supported: BACB RBT certification is not the sole BHT-ABA pathway, and subsection (g) does not impose a general deadline to become an RBT. Preserve the distinction between a training-completion certificate and RBT certification. Include high-school equivalency and the BACB-approved continuing-education-provider option for the experience-plus-training pathway. Conflict with current implementation guidance: the April 2, 2026 OMHSAS letter identifies the Task List wording as outdated and directs use of the RBT Test Content Outline, third edition. It calls for applicable inexperienced new hires to receive third-edition training, transition arrangements for existing/transferring staff, and applicable staff to have third-edition training after 2026. This is a training-update timeline, not a universal deadline to obtain RBT certification, and the regulation itself still contains its older wording. The six onsite hours apply to people without previous BHT-ABA service experience, not automatically every agency hire. The 30-hour initial requirement is conditional on no previous BHT experience; add 24 hours within six months and the documented college-coursework substitution permitted by 5240.73(f). Annual training requires Department approval or a BACB-approved continuing-education provider. The criminal-history/child-abuse cross-references are supported; particular clearance types and renewal intervals were not established here. Specific stricter agency or payer requirements remain unverified.
