Telehealth and telesupervision for ABA in Nebraska

Last researched October 21, 2026

Can a BCBA in Nebraska deliver or supervise ABA by video, and what licensure applies? Answers below say exactly how sure we are.

BCBA licensure

Medium confidence: reputable secondary source
State license required for BCBAs

Yes.

License title

Licensed Behavior Analyst (LBA); Licensed assistant Behavior Analyst (LaBA)

Board

Nebraska DHHS, Office of Behavioral Health Licensing (Board of Behavior Analysts under the Behavior Analyst Practice Act)

Statute or rule

Behavior Analyst Practice Act, Neb. Rev. Stat. 38-4401 et seq. (LBA/LaBA licensure requirement, application and minimum standards in 38-4410; practice defined in 38-4408; statutory exceptions to the licensure requirement in 38-4409); regulations 172 NAC 86, adopted effective January 20, 2025 (the DHHS licensing page still says regulations are 'presently being drafted', which appears stale); 172 NAC 10 also applies alongside 172 NAC 86

Fees and timeline

As of 2026-10-21, per the DHHS page: licenses expire September 1 of even-numbered years; continuing education must be maintained with the certifying entity. Standard application fees are $150 for LBA and $100 for LaBA, subject to waivers and to reduced fees of $37.50 (LBA) / $25 (LaBA) during the March-August window of even-numbered years. A $100 preliminary conviction review is available as an optional step (not automatically required) for applicants with criminal-history concerns. The Medicaid ABA service definition states BCBAs must be LBAs as of 01/01/2025. A historical 90-day enforcement grace period after Sept 2, 2024 appeared in an excerpt of an official FAQ, but the source could not be opened and verified; it should not be treated as a current allowance.

ABA delivered by telehealth

Sometimes. See the detail below.

Detail

As of 2026-10-21, the Nebraska Medicaid ABA service definition allows telehealth only as indicated on the Medicaid Mental Health and Substance Use fee schedule (the current fee-schedule spreadsheet could not be read, so its code-level allowances were not independently verified). 97155 (protocol modification by the licensed clinician) may be done via audiovisual telehealth if 97153 is concurrently being delivered, the environment is assessed safe, caregivers have technology and secure internet, the technology lets the supervisor see the session and give real-time feedback, the individual's behavior does not need more than 1:1 support, distraction plans exist, and documentation justifies telehealth as clinically necessary rather than solely for convenience. 97156 (family guidance) may be done via audiovisual telehealth if caregivers actively participate and the same conditions hold: safety, technology, real-time interaction, no need for greater-than-1:1 support, distraction planning, and documented treatment justification (not used solely for convenience). Other ABA treatment services (97153, 97154, 97158) cannot be provided via telehealth; 97158 is clinician-delivered group treatment. For assessments under the separate Behavior Identification Assessment definition, 97151 may be completed via synchronous audiovisual telehealth under conditions that include an on-site caregiver and adequate patient participation and safety; 97152 (supporting assessment) cannot be completed via telehealth.

Telehealth parity law

Neb. Rev. Stat. 44-7,107(2): commercial coverage may not exclude a service from coverage solely because the service is delivered through telehealth. This is a coverage protection, not a general equal-payment guarantee.

In-person requirements

Technician direct treatment (97153/97154) must be in person; supervisor must observe the technician or LaBA in person at least 1 hour per month; treating LBA/psychologist must provide at least 1 hour per month of in-person direct service.

Supervision by telehealth

Protocol-modification supervision (97155) can be delivered via audiovisual telehealth while the technician delivers 97153 in person, subject to the conditions above, but the monthly in-person supervision observation is still required.

National baseline: BACB telesupervision

Handbook: in-person on-site observation is preferred, but observation 'may be conducted via web cameras, video-conferencing, or similar means'; internet-based supervision must comply with all applicable laws; video monitoring alone without real-time interaction/feedback may not count. Phone or email contacts do not count as the face-to-face contacts. Payer/state rules can be stricter (CMS toolkit says telehealth should be a limited adjunct and 'generally avoided' for routine technician supervision; that is CMS guidance to states, not a BACB rule).

This is the BACB's certification rule for RBT supervision. State, Medicaid or payer rules can be stricter. High confidence for the BACB text as of 2026-10-21.
