Getting a new technician started in Nebraska
Nebraska Medicaid requires an active BACB RBT credential for technician-level billing, so a new BT cannot bill Medicaid until RBT-certified and the agency/rendering provider is Medicaid-enrolled. BCBAs supervising must hold the Nebraska LBA license. Rate cuts and tighter supervision/hour limits in 2025-2026 may affect hiring appetite. A 90-day practice window after licensure launched in 2024 was reported only by a secondary summary and is now past. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Exact Nebraska Medicaid provider enrollment portal URL and steps (Maximus), including provider type codes 83/84/85 (only type 85 for RBT confirmed via Nebraska Total Care).
- Names of all current Heritage Health MCOs and their ABA contracting rules.
- Background check/fingerprinting requirements for BTs or ABA agencies in Nebraska (not found for RBTs; the background-check item in the Medicaid document applies only to certified peer support providers).
- Current LBA/LaBA fees and final 172 NAC 86 regulations.
- Whether Nebraska has commercial telehealth parity applying to ABA, and the Behavior Identification Assessment telehealth rules (97151/97152).
- Exact text of statute 44-7,106(3)-(4) on the 25 hours per week cap and any exceptions.
- bcba_licensure: verifier astra marked conflict - CONFLICT: replace '172 NAC 86 presently being drafted' with 'adopted effective January 20, 2025.' DHHS's opened Title 172 index independently lists that adoption date; the licensing landing page retains stale drafting language. Titles, licensing office, board, qualification/scope citations, expiration cycle, and certification-linked continuing education are supported. Licensure requirements have statutory exceptions under section 38-4409. The $100 preliminary conviction review is optional, not automatically required whenever criminal-history concerns exist. Standard application fees are $150 LBA/$100 LaBA, subject to waivers and the webpage's March–August even-year reductions to $37.50/$25. UNSUPPORTED under the requested opened-page standard: the historical 90-day enforcement grace period appeared in an official FAQ search excerpt, but the PDF and attempted archive could not be opened. Do not present it as a current allowance.
- bt_vs_rbt: verifier astra marked conflict - CONFLICT: an unqualified statewide unregistered_bt_may_deliver='no' is incorrect. Sections 38-4403 and 38-4409(3) permit behavior technicians under specified licensed supervision without making BACB RBT certification part of that statutory definition. Change to conditional: Medicaid technician billing requires the listed RBT or LaBA qualifications; state practice permission and payer reimbursement are separate questions. The Medicaid certification, enrollment, supervision and training claims are supported. Label those requirements Medicaid-specific. Provider type 85 is supported by the cited May 2, 2023 notice, but was not independently reconfirmed against the unreadable current fee schedule. No trainee/grace alternative was identified in the opened Medicaid definitions; this does not establish a statewide prohibition. Commercial technician credential requirements remain unverified.
- practice_requirements: verifier astra marked conflict - CONFLICT: remove the implication that the first 20 weekly hours require no authorization. The current definition requires initial authorization materials, sets ordinary limits of 6 hours/day and 20 hours/week, and requires approved clinical justification for additional hours. Training, scope, 90-day reviews, caregiver participation and crisis access are supported. Crisis access may use qualifying outside crisis resources; an agency need not operate its own 24/7 service. Current caregiver participation is 1 hour/month for recipients receiving at most 10 monthly ABA hours and 2–4 hours for those receiving more, with documented exceptions; the continued-stay paragraph separately retains a blanket 2–4-hour statement. Rates are code-specific: $18.70 for 97153 and $22.72 for 97155, not all RBT/BCBA work. Their publication is verified, but current-schedule confirmation is UNSUPPORTED because the linked revised SFY27 XLSX could not be read. Do not date the rate cuts to July 2026. Facility licensing remains undetermined. Background-check information can identify the verified LBA/LaBA application registry checks without generalizing them to every employee.
