ABA insurance and Medicaid coverage in Nebraska

Last researched October 21, 2026

Who pays for ABA in Nebraska, and what a practice has to do to bill them. Coverage details here come from statutes and agency pages we read, not from payer marketing.

Autism insurance mandate

Medium confidence: reputable secondary source
State mandate for autism coverage

Yes, the research found a state autism coverage law.

Statute

Neb. Rev. Stat. 44-7,106

Age limits

Coverage of screening, diagnosis and treatment of autism spectrum disorder for individuals under 21 years of age.

Annual cap

No annual dollar cap was identified. Per the statute, behavioral health treatment including ABA is subject to a maximum benefit of 25 hours per week until the insured reaches 21 (subsection (4)). Subsection (3) prohibits dollar limits and cost sharing that are less favorable than those applied to equivalent general physical illness coverage; it does not categorically prohibit every dollar limit.

Excludes self-funded employer plans

No, the research did not find that exclusion.

Notes

As of 2026-10-21, the cited statute applies to individual/group sickness and accident policies and hospital/medical/surgical policies delivered, issued or renewed in NE, including policies issued outside Nebraska that insure Nebraska residents, and to self-funded employee benefit plans 'to the extent not preempted by federal law' (so self-funded coverage is qualified by federal preemption, not guaranteed), including State of Nebraska employee plans. Applies to policies delivered/issued/amended/renewed on or after Jan 1, 2015. Excludes specified-disease or limited-benefit coverage, Medicare supplement, accident-only, hospital indemnity, disability income and long-term care policies, and the statute says nothing in subsection (2) applies to non-grandfathered individual and small-group ACA plans required to include essential health benefits. Behavioral health treatment (incl. ABA) is defined as provided or supervised, in person or by telehealth, by a nationally certified behavior analyst or licensed psychologist.
