Practice requirements for ABA providers in Massachusetts

Last researched October 21, 2026

The internal processes a practice in Massachusetts has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.

Requirements for practices

Background checks

Under 262 CMR 8.04(5)(c), as reproduced by Cornell LII, a supervising LABA who employs a non-licensed paraprofessional must conduct a CORI check before hiring. The LABA must retain clinical responsibility and document appropriate supervision. Carelon/MBHP also requires background record checks for all staff.

Staff training

The Massachusetts OIG's March 2024 report describes MassHealth MCE training requirements at hiring and annually thereafter, including population needs, cultural and linguistic considerations, family-centered practice, behavior management, social skills, medication effects, safety, crisis management, child-serving systems, special education, payer specifications, development and conflict resolution. The February 2026 Carelon/MBHP specification additionally expressly lists mandated reporting and requires training in agency policies.

Other requirements

Carelon/MBHP permits ABA telehealth through a HIPAA-compliant platform at the caregiver's request when clinically effective, with documented rationale. In-person availability must remain; withdrawing telehealth consent must not interrupt services. An EOHHS Summer 2026 accreditation presentation publicly posted by WellSense states: center-based providers face a January 1, 2027 deadline, with a conditional corrective-action period through July 1, 2027 for those already pursuing accreditation; new intakes pause during that period. Existing home/community providers retain a January 1, 2028 deadline. Brand-new providers lacking clinical experience may receive up to one year of provisional participation, starting accreditation within 60 days of first MassHealth service and satisfying notification, communication and contract conditions. Existing experienced organizations newly contracting after the applicable deadline must already qualify. The presentation names Point32Health/Tufts, Fallon, MBHP/HNE, Mass General Brigham/Optum and WellSense as contacts. Its final slide bears a policy-development footer; final implementation requires verification.

Supervision requirements

Carelon/MBHP requires LABA supervision during direct service for at least 10% of direct service hours. Exceeding 25% requires documented clinical rationale. Members receiving 10 or fewer direct-treatment hours monthly require at least one hour of direct supervision monthly. Separately, Fallon's MassHealth ACO telehealth policy, effective March 1, 2024, recognizes modifier FR for a supervisor participating through live two-way audio/video. That general billing provision does not establish that every ABA supervision arrangement or code qualifies.

National baseline for onboarding a technician

Items below are supported by BACB or regulator sources. Your state may add more.

  • Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
  • Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
  • Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
  • Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
  • Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
  • For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
  • Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
  • Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
  • For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
  • For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).

Verify any certified technician on the BACB certificant registry.
