Practice requirements for ABA providers in Kentucky
Last researched October 21, 2026
The internal processes a practice in Kentucky has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.
Requirements for practices
- Facility or agency license
Requirements depend on the provider category. As of 2026-10-21, DMS requires Tier 1 behavioral health services organizations (BHSOs; Medicaid provider type 03) to obtain Office of Inspector General licensure under 902 KAR 20:430. Section 3 requires accreditation within one year of initial licensure unless an extension is granted. DMS separately recognizes individual and group behavioral analysts as PT 63/639, requiring Kentucky professional licensure and Medicaid enrollment, plus applicable MCO enrollment. These sources do not establish a blanket facility-license requirement or exemption for every standalone ABA practice.
- Background checks
For BHSOs, 902 KAR 20:430 Section 4(6) requires criminal-record checks through the Administrative Office of the Courts or Kentucky State Police upon initial hire for the executive director and all personnel. Specified sex crimes, violent crimes, offenses against minors and Class A felonies are disqualifying. Personnel must clear the nurse/home-health-aide abuse and caregiver misconduct registries, plus the child-abuse central registry when serving minors. Annually, criminal-record and registry checks must cover a random sample of at least 25% of personnel. Applicability to standalone PT 63/639 practices remains unverified.
- Staff training
BHSOs must maintain an orientation plan and annual staff training covering abuse/neglect/exploitation detection and reporting, behavior management and de-escalation, physical management, and emergency/safety procedures; personnel files must verify training and credentials (902 KAR 20:430 Section 4(7)-(8)). Separately, 201 KAR 43:010 Section 1(3)(e), effective 2022-10-04, requires behavior analyst and assistant behavior analyst license applicants to document at least five hours covering adult abuse/neglect, child abuse/neglect/dependency, or both. This is a professional-license application requirement, not an established universal BT training requirement.
- Other requirements
DMS's PT 63 enrollment summary, revised December 2020, requires an individual provider to have a permanent location, valid NPI and taxonomy registered with NPPES, and a current analyst license; enrollment, revalidation and maintenance applications use KY MPPA. For Medicaid practice staffing, 907 KAR 15:010 Section 3(3)(r) expressly permits supervised RBTs to provide ABA support services; Section 1(1)(d) places billing with the approved practitioner or provider group. It does not establish a non-RBT grace period. The current 201 KAR 43:050 Section 11 requires identifying the actual service deliverer to the client and distinguishing services performed by a supervisee, licensed supervisee or supervisor in billing; this does not itself establish payer reimbursement eligibility. The 902 KAR 20:430 history lists a technical amendment effective 2020-03-20 and certification effective 2026-09-24.

- Supervision requirements
907 KAR 15:010: notes by a practitioner working under supervision must be co-signed and dated by the supervising professional within thirty (30) days; supervising professionals must document monthly consultations reviewing the case, and the monthly note must address both the case and the supervisor's evaluation of services. Telehealth delivery is conditional under 907 KAR 3:170.
National baseline for onboarding a technician
Items below are supported by BACB or regulator sources. Your state may add more.
- Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
- Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
- Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
- Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
- Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
- For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
- Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
- Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
- For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
- For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).
Verify any certified technician on the BACB certificant registry.
