The autism coverage law in Kentucky
KRS 304.17A-142 (coverage for diagnosis and treatment of autism spectrum disorders), created by 2010 Ky. Acts ch. 150, sec. 17, effective January 1, 2011, and amended by 2018 Ky. Acts ch. 86, sec. 1 (HB 218), effective January 1, 2019. Related: KRS 304.17A-144 (autism-benefits liaison; 2016 Ky. Acts ch. 102, effective July 15, 2016); KRS 18A.225(15) (state-employee plans). KRS 304.17A-141 and KRS 304.17A-143 were repealed by 2018 Ky. Acts ch. 86, sec. 2, effective January 1, 2019. See coverage details and sources.
Getting a new technician started in Kentucky
Kentucky law lets unlicensed supervisees work under a licensed behavior analyst without a separate technician license, so no state credential is a gate for starting; Medicaid and payer contracts may still expect an RBT. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Whether Medicaid/MCOs require RBT certification for technicians and any grace window
- Whether self-funded plans are excluded from KRS 304.17A-142 coverage
- Whether the 2012 DOI advisory on supervisee coverage remains in force after the 2018 amendment
- Kentucky ABA board license fees
- Current text of KRS 319C.020 exemptions (read only via secondary search summary; the statute pages returned access errors)
- Medicaid telehealth policy for direct ABA technician services
- State background check, TB, CPR or facility licensing rules for ABA agencies
- Whether the Medicaid provider enrollment page link is current
- Whether a particular standalone ABA practice enrolled as PT 63/639 must also obtain a facility or agency license; BHSO licensure requirements were verified but should not be generalized to every ABA practice
- Personnel background-check and registry requirements for standalone ABA practices outside the verified BHSO category
- Whether statewide TB screening, CPR certification or additional technician-specific training requirements apply to all ABA practices
