Notes

As of 2026-10-21, DC does not appear to have a standalone ABA autism mandate in the sections read, but those sections do not establish that none exists elsewhere. 31-3271 defines habilitative services (including occupational therapy, physical therapy and speech therapy) as services for the treatment of a child with a congenital or genetic birth defect to enhance the child's ability to function, and lists 'Autism or an autism spectrum disorder' among the qualifying conditions. 31-3272 requires coverage of habilitative services for children under the age of 21 and permits delivery through a managed care system. The coverage may not be more restrictive than coverage provided for any other illness, condition, or disorder, including deductibles, benefit year or lifetime durational limits, benefit year or lifetime dollar limits, lifetime episodes or treatment limits, and copayment and coinsurance factors. The statute does not require reimbursement for services actually delivered through early intervention or school services (this is not a prohibition on coverage). The effective trigger is tied to the issuance/renewal of policies and a first-of-month date following March 2, 2007; the exact trigger wording was not confirmed in the checker quotes and should be verified against the Code text. Neither section expressly names ABA, so whether ABA is covered under this mandate must be confirmed. NCSL (2021-08-24) describes DC the same way. annual_cap and excludes_self_funded_plans are left unresolved: these sections supply neither a numerical annual cap nor an express self-funded-plan exclusion, and null here does not mean unlimited coverage or inclusion of self-funded plans.
