The autism coverage law in Vermont
8 V.S.A. 4082 (Early childhood development disorders; recodified from 8 V.S.A. 4088i, eff. Sept 1, 2025; Act 158 of 2012). As of 2026-10-21, the section was also amended by Act 11 of 2025, § 2, and Act 91 of 2026, § 34 (effective April 30, 2026). See coverage details and sources.
Getting a new technician started in Vermont
Vermont's licensing statute and Medicaid guidelines do not require an RBT by name in the sources read, but BCBA supervisors remain accountable for BT work and training; getting the RBT early is still the clearest way to show formal training. Out-of-state licensed analysts may use OPR's Fast Track Endorsement (3 consecutive years licensed). (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Whether Vermont Medicaid (rule and ABA medical policy, Medicaid provider enrollment) requires RBT or any credential for technicians.
- Vermont Medicaid provider enrollment portal URL for ABA providers.
- How OPR treats non-school behavior technicians under 26 V.S.A. chapter 95 (exceptions listed do not clearly cover them).
- Telehealth rules for ABA including telesupervision, and Vermont telehealth parity law.
- Background check or other BT onboarding requirements (agency, DVHA, Agency of Human Services).
- Major commercial and Medicaid payers in Vermont.
- Self-funded plan applicability of the mandate and OPR fee amounts.
- A general OPR interpretation of non-school behavior technicians under 26 V.S.A. chapter 95 remains unverified. Medicaid recognition of supervised BT services does not establish unrestricted independent practice authority.
- Commercial-plan-specific permission to use non-RBT technicians, rendering-provider/NPI requirements and any additional credential conditions remain unverified. MVP's lack of separate RBT credentialing is not proof that BACB certification is optional.
- Whether 2026 HCAR amendments changed the BT degree/experience definition reproduced by Justia as current through June 2025 remains unverified; current agency rule PDFs were inaccessible.
- ABA audio-only eligibility, claim modifiers, and remote supervision outside the documented 97155 arrangement remain unverified. Commercial ABA telehealth code policies were not established.
- Whether a standalone ABA clinic or agency needs an additional facility/agency license remains unverified. Background-check and training rules outside the Medicaid ABA benefit were not established.
- The medicaid_aba section was preserved under the requested three-section scope. Its guideline-only 'unknown' credential status and null enrollment URL reflect the earlier review; newer supervised-BT evidence and the verified enrollment portal are recorded in bt_vs_rbt and practice_requirements. The 2024 guideline alone is not a complete onboarding checklist.
- Major commercial and Medicaid payers by market share or enrollment remain unverified; payer-specific documents reviewed here do not establish a market ranking.
- Self-funded plan applicability of the insurance mandate and OPR fee amounts remain unverified.
- autism_insurance_mandate: verifier astra marked conflict - The conflict concerns statutory currency, not the stated coverage age. Add Act 11 of 2025, § 2, and Act 91 of 2026, § 34, effective April 30, 2026. The latter restored 'under' before 21 in § 4082(a)(3)(A); the opened individual-section copy still displayed the older wording, while the full-chapter copy includes the correction. The mandate, evidence-based diagnosis/treatment, ABA supervision, Medicaid inclusion, EHB limitation, medical-necessity/prior-authorization terms and cost-sharing parity are supported. Add the inpatient exception to treatment-plan reviews. For natural-environment services furnished under a licensed professional, specify direct supervision; the ABA analyst alternative says supervision. No numerical annual dollar cap appears in § 4082, but this does not establish unlimited benefits. Keep the self-funded-plan field unresolved; the cited sources do not establish a categorical exclusion.
