The autism coverage law in South Carolina
S.C. Code Ann. § 38-71-280 (added by 2007 Act No. 65, R.85, S.20). Effective July 1, 2008, for health insurance plans issued, renewed, delivered, or entered into on or after that date. The current Code history lists no later amendment. See coverage details and sources.
Getting a new technician started in South Carolina
In SC Medicaid a new BT can start in a clinic setting (BCBA/BCaBA on site) before holding the RBT credential, but only during a one-time 90-day period counted from the first date of service to Medicaid members; it does not reset if the BT changes employers. Home and school work needs the full RBT first. Expect the employer to need a current SLED check plus child abuse and sex offender registry checks before start. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Names of SC Medicaid MCOs and commercial payers' ABA policies (not researched/sourced).
- Whether self-funded plans are exempt from the SC mandate (statute silent; ERISA question for counsel).
- Current CPI-adjusted dollar amount of the $50,000 annual cap.
- Whether SC has enacted any behavior analyst licensure law after the 2021-2022 session (S.630 was shown in committee; no later enactment verified).
- Telesupervision rules for RBT supervision under commercial plans and the BACB.
- SC telehealth parity statute for commercial insurance (not researched).
- Exact URL status of the SCDHHS provider-enrollment page cited as enrollment link (taken from links on the ASD provider page; target page itself not opened).
- medicaid_aba: verifier astra marked conflict - Coverage, SCDHHS administration, EPSDT under 21, enrollment categories, technician qualifications, RBT billing, and the stated supervision details appear in the opened materials. However, the cited PDF is linked as the May draft. Its current replacement returned 502, and the archive attempt failed; draft-only details are not verified current policy. Printed pp.4–5 start the grace period at first Medicaid service; p.28 and July training use first hire. Onsite-supervisor requirements also conflict. The draft's p.40 omits RBTs from home/school 97153 delivery, contradicting p.19 and training slide 53, which permits RBTs. Distinguish LIP non-ABA services from certified-analyst ABA services. QIO authorization concerns fee-for-service; MCOs administer their own authorizations. Do not claim every service requires authorization: training expressly exempts 97151. The draft additionally extends eligibility through the month of the 21st birthday. The [June implementation bulletin](https://www.scdhhs.gov/communications/updates-asd-services-provider-manual-0) preserves previously authorized services under their earlier policy.
- telehealth_aba: verifier astra marked conflict - The draft's 3:1 maximum contradicts its 25% telehealth ceiling: mathematically, a 25% ceiling requires at least three in-person units per telehealth unit. Flag the drafting conflict; do not publish the ratio as an operational rule or apply it to 97156. July training confirms GT/POS 02 or 10, prohibition of telehealth 97151/97152/0362T/97153/97154, permission for 97156, conditional QIO-approved 97155, in-person member-facing BIA/FBA, and rejection of telehealth autism evaluations for access. Its 97155 exception addresses severe access barriers for home-based treatment; the rural-only restriction appears in the draft and is not independently confirmed in the final manual. Correct SCMSA to include all South Carolina plus qualifying adjacent areas. Professional supervision cannot be billed as 97155. Earlier policy expressly discussed telesupervision, but its continued 2026 scope remains unverified. Preserve telehealth_parity_law:null. Also preserve the [June bulletin's transition protection](https://www.scdhhs.gov/communications/updates-asd-services-provider-manual-0) for services authorized before July 1.
- bt_vs_rbt: verifier astra marked conflict - Replace first Medicaid service with first hire, as clarified by July training. The one-time clock, non-reset rule, clinic-only BT delivery, recoupment, age 18+, and diploma/equivalent are supported by that training. It allows onsite BCaBA/BCBA/BCBA-D supervision and RBT delivery in approved home/school settings, resolving those points differently from portions of the draft. Annual SLED and pre-employment/annual child-abuse and sex-offender checks appear in the draft; their final-manual wording remains unverified. Keep these requirements explicitly Medicaid-specific.
