Practice requirements for ABA providers in New Mexico

Last researched October 21, 2026

The internal processes a practice in New Mexico has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.

Requirements for practices

Facility or agency license

Background checks

As of 2026-10-21, 8.321.2.13 NMAC requires a criminal background registry check for ABA providers and practitioners. The earlier citation to 8.321.2.12 NMAC was corrected. The effective date previously listed (1/1/2020) was not confirmed in this audit. Supplement 22-02 was previously cited as repeating this requirement for specific credential categories, but that category-level detail was not re-verified.

Staff training

Training hours for non-certified BTs (previously stated as 4 hours of ASD training plus 40-hour RBT/BCAT-aligned training) were not re-verified here. See the bt_vs_rbt section for credential and timing details. Medicaid ABA is delivered through an enrolled ABA provider agency following a three-stage evaluation, assessment and treatment model, with agency-based delivery supported for Stages 2 and 3.

Other requirements

The HCA lists attestation templates for enrollment, including BCBA/BCBA-D, BCaBA, AEP, RBT/BCAT, non-certified BT and specialty care. The earlier statement that agencies enroll through the YES.NM.GOV provider system could not be verified in this audit and should be treated as unconfirmed. Per Supplement 22-02, service authorization periods are 3 years for ages 12 months to 8 and 6 years for age 8 and older. These are not uninterrupted treatment approvals: under current 8.321.2.13 NMAC subsection E(1), Stage 3 continuation requires authorization every six months. If the BH billing manual conflicts with the NMAC rules, the NMAC rules control.

Medicaid supervision and enrollment

Medium confidence: reputable secondary source
Supervision requirements

A BA (BCBA/BCBA-D/qualifying psychologist) must be approved to supervise BAAs, RBTs, BCATs and non-certified BTs and provides the MAD-required supervision; a BCaBA may supervise BTs if approved by the BA. The SPA's BT provision requires one hour of case supervision per 10 intervention hours per individual. Case supervision is billed with T1026 UD (direct and indirect) and supervision required solely for the practitioner's own BACB/BICC certification is not reimbursable by MAD; both match the 2022 supplement, but current HCA billing instructions were not verified. Mentored BAs (certified under 3 years) must be supervised by a BA with at least 3 years of BA supervisory experience.

National baseline for onboarding a technician

Items below are supported by BACB or regulator sources. Your state may add more.

  • Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
  • Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
  • Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
  • Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
  • Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
  • For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
  • Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
  • Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
  • For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
  • For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).

Verify any certified technician on the BACB certificant registry.
