Practice requirements for ABA providers in New Jersey

Last researched October 21, 2026

The internal processes a practice in New Jersey has to run before and after a technician starts. A practice, not MeetAllo, remains responsible for compliance.

Requirements for practices

Medium confidence: reputable secondary source
Facility or agency license

Background checks

As of 2026-10-21, the current NJMMIS ABA fee-for-service enrollment packet requires fingerprint-based background checks for independently billing providers and agency heads. It also states that no agency employee may provide direct services to NJ FamilyCare members without first passing the background check.

Staff training

N.J.A.C. 13:42B-5.1 separately requires eight-hour supervisor training for LBAs supervising LaBAs. Technician qualification and delegation rules also apply, but their details were not confirmed here. Check the current NJMMIS ABA enrollment packet.

Other requirements

Agencies not already NJ Medicaid providers: (1) enroll as a NJ FamilyCare Medicaid provider through Gainwell provider enrollment, using the current NJMMIS Applied Behavior Analysis enrollment packet. The older ASD Treatment Provider Addendum, as linked by Autism New Jersey, is limited to providers already enrolled in NJ FamilyCare fee-for-service and should not be assumed to apply to new providers. (2) Contract with the MCO of each member served, or obtain an applicable single-case agreement. 2026 DMAHS guidance says the provider must be in network with the MCO and/or have a single case agreement to serve the member. Autism New Jersey says enrollment and MCO contracting can be done simultaneously; the sources do not require doing them in sequence or contracting with every MCO. The 'authorization-only' shortcut applies only to providers already contracted with an MCO. DCF/CSOC participation alone does not establish that shortcut. State contact for the ABA benefit: MAHS.ASDinquiries@dhs.nj.gov (per Autism New Jersey, secondary). A universal standalone ABA facility or agency licensing requirement was not established by the sources reviewed. This is unverified, not an exemption.

Supervision requirements

Per the April 2020 newsletter, an RBT must practice under close, ongoing supervision of a BCBA-D, BCBA or BCaBA. The newsletter expressly permits direct treatment by the qualified healthcare professional under 97155 and prohibits billing supervision when the technician is not present. Concurrent billing with 97155 is limited to qualifying patient-facing treatment or protocol-modification activity; ordinary personnel supervision is not automatically billable. The newsletter states no supervision hour-percentage ratio. Current MCO and NJMMIS requirements were not confirmed.

National baseline for onboarding a technician

Items below are supported by BACB or regulator sources. Your state may add more.

  • Verify RBT status on the BACB Certificant Registry (status, expiration, listed supervisor; red text means may not practice) or via portal verification report / $25 written verification.
  • Ensure a qualified BCBA/BCaBA supervisor (with completed supervisor training 2.0) or RBT Requirements Coordinator lists the RBT as supervisee in their BACB portal before the RBT provides services as an RBT.
  • Assign a supervisor/Coordinator for every client the RBT serves; no relation, employer-superior or multiple relationship with the RBT.
  • Plan supervision: 5% of monthly service hours, at least two real-time contacts per month, one individual, one observation of services; document dates, durations, format, observations; retain 7 years.
  • Criminal background check and abuse registry check comparable to those for home health aides/child care/teachers, within 180 days before the application is paid; fingerprinting may be required by state or organization.
  • For applicants: have a BCBA/BCaBA Responsible Assessor (with 8-hour supervision training, same organization as applicant and clients, not related/subordinate/employed by the applicant at the time of assessment) complete the ICA after the 40-hour training; keep assessment records 7 years.
  • Attesting Certificant for the application attestation must not be related to, subordinate to, or employed by the applicant.
  • Correct worker classification (employee vs contractor) for RBTs; BACB may ask for a tax professional's written opinion in an ethics matter.
  • For TRICARE ACD enrollment: RBT/ABAT/BCAT or state certification, current BLS/CPR, authorized ABA supervisor named, 10-year federal/state/county criminal and sex-offender history check.
  • For Medicaid/commercial payers: confirm state Medicaid or payer definition of technician qualifications, enrollment and credentialing before billing (state-specific).

Verify any certified technician on the BACB certificant registry.
