Getting a new technician started in Georgia
A technician can generally work under a licensed behavior analyst without a state license (statutory technician exemption), but Medicaid billing historically assumes an RBT-level technician working under an enrolled QHCP; supervisor capacity is limited (BCBA up to six supervisees in the 2018 manual). A BCBA must hold a Georgia license to practice. (Our research note; confirm with the agencies on the BT vs RBT page.)
What we are still checking
- Current (2026) Georgia Medicaid ASD manual: RBT requirement for technicians, any experience minimum, supervision ratios, telehealth rules (the Q3 July 2026 manual URL returned 404; only the January 2018 version was read).
- Georgia Behavior Analyst Licensing Board current application window, fees and grandfathering (board site returned 403; a search snippet mentioned an April 1, 2026 application date that was not confirmed).
- Enacted text of O.C.G.A. 43-7A (only the Senate committee substitute of HB 412 was read) and codified text of 33-24-59.10 (SB 118 substitute read).
- Whether the mandate applies to self-funded plans.
- Background check, TB, CPR or other BT onboarding items required by Georgia Medicaid or ABA employers.
- Georgia telehealth statute text (33-24-56.4) and whether RBTs may deliver or be supervised via telehealth.
- Provider enrollment URL for Georgia Medicaid (BCaBAs/RBTs are not enrolled individually per 2018 manual).
- Scoped update: the October 2026 ASD manual was retrieved. Current findings appear in practice_requirements. The unchanged Medicaid, telehealth, BT and fast-track sections retain older findings. Their unresolved-RBT and in-person-supervision statements are superseded by practice_requirements; the historical experience minimum and supervisee cap were not revalidated.
- Whether a standalone outpatient ABA practice requires a separate facility or agency license remains unverified. DCH's facility listings do not establish an ABA exemption; facility_or_agency_license remains null.
- Additional Georgia-specific screening, TB testing, CPR/first-aid or onboarding requirements applying to all BTs remain unverified. BACB certification checks and analyst-license fingerprint checks should not be treated as a universal BT employment rule.
- Aetna's general participation criteria were verified, but acceptance and billing of an uncertified BT under a specific Georgia commercial plan or provider contract remain unverified. Requirements of other commercial payers were not established.
- Georgia Behavior Analyst Licensing Board application and renewal fees and any grandfathering provisions remain unverified. The original bcba_licensure fee estimates are bill-stage figures. The board website was accessible during this pass, and its April 1, 2026 application notice was verified.
- The enacted HB 412 text was opened from the Governor's signed-legislation archive and supports the practice_requirements update. The out-of-scope licensure and BT sections retain their earlier substitute-bill citations. Current codified O.C.G.A. 33-24-59.10 remains unverified.
- Whether the insurance mandate applies to self-funded plans remains unverified.
- Georgia telehealth statute text, O.C.G.A. 33-24-56.4, remains unverified. The practice_requirements update establishes specific Medicaid and BACB requirements, not a complete commercial-plan telehealth policy.
- The official Medicaid enrollment URL was opened and is included in practice_requirements.sources. The separate medicaid_aba.provider_enrollment_url field was left unchanged because this pass was limited to practice_requirements.
- autism_insurance_mandate: verifier astra marked conflict - The age, annual amount, visit-limit prohibition and January 1, 2019 effective date are supported. Correct medical necessity: [§33-24-59.10(b)(2)](https://law.justia.com/codes/georgia/title-33/chapter-24/article-1/section-33-24-59-10/) assigns the ABA coverage determination to the covering entity using established criteria. A licensed physician or psychologist may be required to demonstrate continuing necessity at least annually; that is a separate provision. Replace the self-funded uncertainty with an exclusion qualified to self-funded ERISA employer plans, supported by the insurance regulator; do not generalize it to every governmental or other self-funded arrangement. The cited House-substitute URL failed to decode, so the findings use the opened codified text and official Senate publication.
- medicaid_aba: verifier astra marked conflict - Coverage and most explicitly historical descriptions are supported. However, the 2018 manual is internally inconsistent: §601.3 permits a physician/psychiatrist/BCBA-D/BCBA to supervise six certified practitioners, while Appendix B limits licensed non-BCBA providers to three. Do not present that as a coherent current rule. Replace operational guidance with the opened [October 2026 manual](https://www.mmis.georgia.gov/portal/Portals/0/StaticContent/Public/ALL/Handbooks/Autism%20Spectrum%20Disorder%20Q4-October%202026%2020261001130506.pdf): analysts need Georgia licensure plus BACB certification; RBT/BCaBA services identify the supervising BCBA on claims; BCaBAs/RBTs remain non-enrolled. This edition does not state the old one-year experience rule, six/three limits or staffing-attestation requirement. Delegation, competency and contemporaneous-record duties remain. Update the agency division to Division of Medical Assistance Plans and populate provider_enrollment_url with the opened [GAMMIS enrollment application](https://www.mmis.georgia.gov/portal/Default.aspx?tabid=30).
- bcba_licensure: verifier astra marked conflict - Licensure, titles, HB 412 enactment, July 1, 2023 effectiveness, fingerprint checks and the $1,000 fine are supported, subject to statutory exemptions. The Senate-substitute URL failed, but the enacted official copy opened. Cite administrative Department 75, including Rules 75-4-.01 and 75-5-.01, rather than 'chapter 75.' The board website now opens. Replace fiscal estimates with its [posted fee schedule](https://sos.ga.gov/sites/default/files/forms/GA%20Behavior%20Analyst%20Licensing%20Board-Fee%20Schedule_1.pdf): applications $150 LBA/$100 LaBA plus $5 online processing; renewals $75/$50; expiration July 31 of odd-numbered years. The homepage specifies April 1, 2026 as an application deadline, not a license-issuance deadline, and directs assistants to wait until their supervisor is licensed. State licensing is not categorically BACB-only: qualifying board-recognized certifying entities are permitted. [§43-7A-2(5)](https://law.justia.com/codes/georgia/title-43/chapter-7a/section-43-7a-2/) was amended effective July 1, 2026 to require a nonprofit certifying entity. Include the degree requirements and ongoing licensed-analyst supervision for assistants.
- telehealth_aba: verifier astra marked conflict - Telehealth availability and statutory parity are supported, but the guidance needs updating. CCHP and its attempted archive were inaccessible; the claimed May 27, 2026 update and April-handbook attribution remain UNSUPPORTED. The separate telehealth handbook also could not be retrieved, so code-specific permissions and direct RBT telehealth delivery remain unverified. The opened [October ASD manual](https://www.mmis.georgia.gov/portal/Portals/0/StaticContent/Public/ALL/Handbooks/Autism%20Spectrum%20Disorder%20Q4-October%202026%2020261001130506.pdf), §903.3, requires readiness documentation with PA and increases audits above 25% remote assessments or 50% remote units; these are not caps. Section 601.3.1 requires some in-person supervision for quality. [§33-24-56.4(g)](https://law.justia.com/codes/georgia/title-33/chapter-24/article-1/section-33-24-56-4/) requires at least the in-person reimbursement rate. Subsection (f)'s initial-visit prohibition has exceptions for device installation/setup/delivery and other state or federal requirements.
